Terms of Service

These Terms of Service ("Terms") govern your access to and use of Dramax Studio and related services (the "Service") operated by Dramax Interactive Inc. ("Dramax", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. The Service

Dramax Studio allows you to generate video and image content using artificial intelligence based on prompts, images, and other input you provide. Generation is powered in part by third-party AI inference providers.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Credits, Payment & Billing

• The Service is billed on a credit or usage basis. Credits are purchased in advance and consumed as you generate content.
• Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms and privacy policy in addition to these Terms.
• Purchased credits are non-refundable except where required by applicable law or at our sole discretion.
• We may change pricing at any time; changes will not affect credits already purchased.

5. Acceptable Use Policy

You agree not to use the Service to create, upload, or distribute content that:

• Depicts minors in any sexual, exploitative, or suggestive manner;
• Depicts non-consensual sexual content, or sexual content involving a real, identifiable person without that person's explicit consent;
• Is illegal, defamatory, or infringes the intellectual property, privacy, or publicity rights of any third party;
• Promotes violence, terrorism, hate, or discrimination against any individual or group;
• Impersonates any person or entity in a fraudulent or misleading manner.

We reserve the right to remove content and suspend or terminate accounts that violate this policy, and to report unlawful content to appropriate authorities where required.

6. Your Content & Generated Output

You retain ownership of the input you submit. Subject to your compliance with these Terms, you own the output generated for you and may use it for lawful purposes. You are solely responsible for the input you provide and the output you generate, share, or distribute.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by Dramax and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

8. Third-Party Services

The Service relies on third-party providers, including AI inference and payment processing providers. We are not responsible for the acts or omissions of these third parties, though we select providers we believe to be reputable.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, Dramax shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Dramax in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Dramax Interactive Inc. is incorporated, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
